Litigation & Appeals

Long Island Law Firm: Litigation and Appeals

At Campolo, Middleton & McCormick, LLP, we believe that the most effective way to negotiate on your behalf is to always be prepared to go to trial. We will immediately develop a targeted, strategic approach to your case and will individually handle your matter from inception through trial and appeal.  Our attorneys have substantial trial experience in federal, state and local courts representing individuals and businesses in a vast array of legal matters.

Corporate and Commercial Matters
Our experience in these areas includes representing clients in state, local and federal courts. Representative matters include shareholder and employment disputes, breach of fiduciary obligations (board members/shareholders), RICO, antitrust, securities, fraud, UCC, breach of contract, banking, breach of warranty, interference with business relations/contracts, Intellectual Property, construction, real estate (including zoning hearings, Article 78 proceedings, and lease disputes), labor and employment, trust and estates, debtor/creditor, and appeals of these matters.

Real Estate
Campolo, Middleton & McCormick represents clients in all aspects of real estate litigation, including real estate title claims; boundary disputes; adverse possession and easement matters; real estate contract disputes; and landlord/tenant disputes and proceedings. The firm also represents clients in disputes involving cooperatives, condominiums and homeowners associations.

Appeals
Results achieved early in a case by motion practice or later at trial are only worthwhile if they can be protected on appeal. Campolo, Middleton & McCormick has written and successfully argued appeals in a wide variety of cases in both State and Federal court.

Insurance
Insurance clients, either the carrier or the insured, often feel frustrated as a result of being represented by lawyers who do not respond to their individual needs. We understand and address the needs of both the claims professional and insured through a targeted and aggressive approach to litigation. As a result, defending third-party lawsuits and representing insurance carriers in alternate dispute settings is a cornerstone of the practice.

Alternative Dispute Resolution
The firm assists clients in resolving disputes without litigation through various alternative dispute resolution procedures, including nonbinding and binding arbitration, mediation, mini-trials, summary jury trials, expert fact-finding and early neutral evaluation. We also structure dispute resolution contract clauses for inclusion in client contracts, represent clients in individually tailored ADR proceeding and serve as arbitrators, mediators and other neutrals in ADR proceedings.

Regulatory Agencies
Companies and individuals regularly turn to us for representation before state and federal regulatory agencies, including the NYC Department of Consumer Affairs (DCA), the New York and U.S. Departments of Labor (DOL), Securities and Exchange Commission (SEC), the New York Department of Environment Conservation (DEC), the federal Environmental Protection Agency (EPA), the New York Unemployment Insurance Department, and state and federal tax authorities (IRS & NYSTF). We also have experience representing individuals in school disciplinary hearings at both the K-12 and college levels.

Environmental and Land Use
Our environmental and other land use litigation experience includes actions under Article 78, 1983, CERCLA, PMPA, NYS Navigation Law, and others. We also have experience representing businesses and individuals before the New York Department of Environment Conservation (DEC), the federal Environmental Protection Agency (EPA), and dozens of different state and local zoning and Municipal boards throughout the State.
